Space Policy and Economy

EU space policy turns public infrastructure into navigation, Earth-observation, secure-communication and space-safety services. Regulation (EU) 2021/696 governs the 2021–2027 EU Space Programme: Galileo, EGNOS, Copernicus, Space Situational Awareness and GOVSATCOM. Regulation (EU) 2023/588 adds the Secure Connectivity Programme and IRIS². The Commission manages the programmes, EUSPA performs operational and user-oriented tasks, and the European Space Agency contributes technical expertise under agreements but is not an EU agency. The EU Space Act proposed in June 2025 remained under negotiation on 17 August 2026.

A special parallel competence

Article 189 TFEU allows the Union to draw up a European space policy, promote scientific and technical progress, industrial competitiveness and implementation of other EU policies, and establish a European space programme. Measures may promote joint initiatives, support research and coordinate exploration and exploitation of space. They may not harmonise Member States’ laws under Article 189. Article 4(3) TFEU adds an unusual rule: EU research, technological-development and space action does not prevent Member States from exercising their own competences.

Space is therefore neither an exclusive EU domain nor an ordinary field in which Union action displaces national programmes. Member States maintain space agencies, launch facilities, security responsibilities and national laws. EU action adds shared infrastructure, services, procurement and standards. Other legal bases remain available when the true objective lies elsewhere. The Commission’s proposed EU Space Act uses Article 114 TFEU because it seeks internal-market harmonisation that Article 189 expressly excludes.

Know the programme components

Galileo is the EU’s autonomous global satellite-navigation system. It supplies positioning, navigation and timing services, including an encrypted Public Regulated Service for authorised governmental users. EGNOS is different: it augments signals from global navigation systems over its service area, improving accuracy and providing integrity information valuable for safety-critical uses such as aviation. Galileo is a global constellation; EGNOS is a regional augmentation service.

Copernicus is the EU Earth-observation programme. Sentinel satellites, contributing missions and in-situ data support services for atmosphere, marine environment, land, climate change, security and emergencies. Its data serves environmental monitoring, agriculture, disaster management and policy enforcement. Copernicus does not provide satellite navigation, and Galileo does not produce Earth-observation imagery.

Space Situational Awareness, or SSA, covers knowledge of hazards in the space environment. Its Space Surveillance and Tracking sub-component provides collision-avoidance, fragmentation and re-entry services using national sensors and operations centres coordinated through the EU SST partnership. Space weather and near-Earth-object functions address other hazards. It should not be confused with Earth observation: SSA watches the orbital and space environment to protect space and ground interests.

GOVSATCOM pools and shares secure satellite-communication capacity for authorised governmental users. It supports crisis management, surveillance and key infrastructure when assured connectivity matters. The GOVSATCOM Hub matches user needs with available resources. Initial operations began in January 2026. GOVSATCOM is a service-pooling component; it is not itself the future IRIS² constellation.

Commission, EUSPA and ESA

The Commission has overall responsibility for implementing the EU Space Programme, managing priorities, budgets, agreements and high-level security requirements. The European Union Agency for the Space Programme—EUSPA—is the user-oriented operational EU agency. Its tasks include Galileo and EGNOS exploitation and security, market uptake of Union space data and services, the GOVSATCOM Hub, secure-connectivity responsibilities and the EU SST Front Desk. Its independent Security Accreditation Board takes accreditation decisions for programme components.

The European Space Agency—ESA—is a separate intergovernmental organisation. Its membership and legal order are not identical to the EU’s. The EU entrusts technical, design and development tasks to ESA under financial framework partnership and contribution agreements. ESA also runs its own mandatory and optional programmes for its members. Calling ESA an EU institution or EUSPA the builder of every EU satellite is wrong. EUMETSAT, national agencies, industry and research bodies also implement important parts of the ecosystem.

Funding, ownership and services

Regulation (EU) 2021/696 set a maximum financial envelope of €14.88 billion in current prices for 2021–2027: €9.017 billion for Galileo and EGNOS, €5.421 billion for Copernicus and €442 million for SSA and GOVSATCOM. This is a seven-year legal envelope, not yearly spending. Horizon Europe, the EU budget, Member-State programmes, ESA contributions, the European Investment Bank and private capital also finance the wider space economy.

The Union owns specified tangible and intangible assets created or developed under the programme, subject to the regulation and agreements. Ownership does not mean the Commission physically operates every satellite or sensor. Management, development and operations are distributed by component. EU services often support private downstream products: navigation chips, climate analytics, precision agriculture, logistics and emergency applications. Open data can create economic value even when the underlying infrastructure is publicly financed.

Secure connectivity and IRIS²

Regulation (EU) 2023/588 established the Union Secure Connectivity Programme for 2023–2027. Its IRIS² infrastructure is designed to provide resilient, autonomous and cost-effective governmental communications while enabling commercial connectivity. It combines low- and medium-Earth-orbit assets, includes cyber and supply-chain security requirements and seeks synergies with GOVSATCOM and EuroQCI. The regulation is adopted and in force; deployment is a continuing programme, not an already completed constellation.

In December 2024 the Commission signed a 12-year concession with the SpaceRISE consortium for a system of 290 satellites and associated ground infrastructure. Governmental and commercial services are planned for 2030. Financing combines EU and ESA public contributions with private investment, while commitments beyond the current financial framework remain subject to future budget decisions. Candidates should distinguish the binding 2023 programme regulation, the signed concession and the future service milestone.

The proposed EU Space Act

The Commission proposed the EU Space Act, COM(2025) 335, on 25 June 2025. It responds to fragmented national authorisation frameworks and rising congestion, debris, cyber and environmental risks. Three pillars structure the proposal: safety through tracking and debris-mitigation rules; resilience through tailored cybersecurity and risk management; and environmental sustainability through a common assessment method. The proposed framework would cover relevant EU operators and non-EU providers offering space-based data or services in the Union, with proportionate regimes and specified exclusions.

The proposal relies on Article 114 TFEU and would use a regulation to harmonise internal-market conditions. It proposes national authorisation and supervision backed by technical assessments, mutual recognition for covered requirements, an EU register and roles for EUSPA. Defence and national-security objects are excluded in defined circumstances. The Commission text proposes application from 1 January 2030 with transitional provisions, but neither that date nor the detailed obligations are final before adoption.

On 17 August 2026 Parliament and Council were negotiating under the ordinary legislative procedure. “Proposed,” “adopted,” “in force” and “applicable” must not be mixed. Existing national rules, international obligations and applicable EU sectoral laws continued to govern while negotiations proceeded.

A strategic and commercial ecosystem

The June 2025 Vision for the European Space Economy looks to 2050 and contains more than 40 actions on coordination, access to finance, skills, procurement, standardisation and international partnerships. It proposes “Space Team Europe” cooperation among the Commission, Member States, ESA, EUSPA and industry. This vision is a policy strategy, not a fund or binding act.

Space infrastructure is dual-use and vulnerable to cyberattack, jamming, debris and hostile interference. The 2023 EU Space Strategy for Security and Defence seeks better threat understanding, resilience, response and use of space for security and defence while retaining the civil nature of the EU Space Programme. Security accreditation protects EU systems; foreign and security policy decisions remain with the competent EU and national actors.

Exam method: identify service and governor

Start by identifying the service: navigation, augmentation, Earth observation, orbital safety or secure communication. Then identify the instrument and actor. The Commission manages, EUSPA operates assigned services and connects users, ESA supplies technical expertise under agreements, and Member States contribute sensors, authorisations and national capabilities. Finish with status: the 2021 and 2023 regulations are in force, GOVSATCOM began initial operations, IRIS² deployment continues and the Space Act remains proposed.
