Competence and coordination

Article 168 TFEU requires a high level of human-health protection in all Union policies. Union action complements national policies, encourages cooperation and addresses major cross-border health scourges. Member States retain core responsibility for defining health policy and organising and delivering health services and medical care.

This division explains many exam scenarios: the EU coordinates, supports, funds, regulates products and acts where cross-border scale creates added value; it does not become the general operator of national health systems.

Regulation (EU) 2022/2371

The serious cross-border threats Regulation strengthens prevention, preparedness, surveillance, early warning, risk assessment and coordinated response. It covers communicable diseases plus biological, chemical, environmental and unknown-origin threats that may spread across borders or overwhelm national response capacity.

Core architecture:

• •a Union prevention, preparedness and response plan;
• •national reporting and ECDC assessments of preparedness capacities;
• •epidemiological surveillance and monitoring networks;
• •the Early Warning and Response System (EWRS);
• •independent public-health risk assessment by the competent Union agency or body;
• •Health Security Committee coordination;
• •Commission recognition of a public-health emergency at Union level under the Regulation's conditions;
• •joint procurement of medical countermeasures.

Do not confuse an EWRS alert with recognition of an EU-level emergency. An alert shares information and triggers coordination. Formal recognition uses the Regulation's decision process and may unlock additional emergency architecture.

Health Security Committee

The HSC coordinates prevention, preparedness and response planning and supports coordination of risk and crisis communication. It brings Member States and the Commission together. It does not replace Member State authorities or the scientific mandate of ECDC, EMA or another risk assessor.

A strong policy answer separates:

• •scientific risk assessment;
• •operational and political coordination;
• •national implementation;
• •medical-countermeasure supply action;
• •public communication.

ECDC

Regulation (EC) No 851/2004, strengthened by Regulation (EU) 2022/2370, establishes ECDC. Its work includes EU/EEA surveillance, epidemic intelligence, risk assessment, scientific advice, preparedness support, laboratory coordination and support through the EU Health Task Force.

ECDC recommendations are normally science-based and non-binding. Member States remain responsible for public-health measures. A correct option will rarely claim that ECDC orders national restrictions or authorises medicines.

EMA in crisis preparedness

Regulation (EU) 2022/123 gives EMA crisis roles that include:

• •monitoring and mitigating shortages of critical medicines and certain medical devices during major events or public-health emergencies;
• •coordinating information through shortage steering structures and single-point-of-contact networks;
• •scientific support for development and evaluation of potential emergency medicines through the Emergency Task Force;
• •support for clinical trials, authorisation and safety monitoring.

EMA does not procure national stockpiles and does not replace the Commission or Member States in supply contracting.

HERA

The Commission established HERA to improve anticipation of health threats and the development, manufacturing, procurement, stockpiling and equitable availability of medical countermeasures.

HERA has two operational modes:

• •Preparedness: threat intelligence, research and innovation support, capacity building, supply-chain work, procurement preparation and stockpile coordination.
• •Crisis: targeted actions under the activated emergency framework, including crisis-relevant countermeasure monitoring, procurement and manufacturing measures.

HERA is a Commission service. ECDC is an agency focused on disease prevention, surveillance and risk assessment. EMA is an agency responsible for medicines and specified device-related crisis tasks. Actor questions often test this distinction.

Emergency Framework Regulation

Council Regulation (EU) 2022/2372 creates a framework for crisis-relevant medical countermeasures. After a public-health emergency is recognised, the Council may, on a Commission proposal, activate appropriate measures for a limited period.

Possible measures include:

• •a Health Crisis Board;
• •monitoring of supply and demand;
• •procurement and purchase;
• •emergency research and innovation plans;
• •emergency funding;
• •inventories of production facilities, raw materials, devices and infrastructure;
• •measures to increase production;
• •activation of reserved manufacturing capacity.

The Council activation must specify which measures apply. Recognition of an emergency does not automatically activate every possible measure.

Union preparedness plan

The Commission's 2025 Union prevention, preparedness and response plan is an operational framework under Article 5 of Regulation 2022/2371. It structures the cycle around prevention and preparedness, detection and assessment, response, and recovery. It is a plan and toolbox, not a new regulation transferring national health-system competence.
